JUSTCOOK Terms of Service

1. Acceptance of Terms

Welcome to JUSTCOOK! These Terms of Service ("Terms") constitute a legally binding agreement between you and JUSTCOOK ("we," "us," or "our") governing your access to and use of the JUSTCOOK mobile application, website, and related services (collectively, the "Service").

By creating an account, downloading, installing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility and Account Requirements

2.1 Age Requirements

You must be at least 13 years of age to use the Service. If you are under 13 years of age, you may not use the Service under any circumstances. If you are between 13 and 18 years of age, you may only use the Service with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms.

2.2 Account Registration

To access certain features of the Service, you must create an account by providing accurate and complete information, including a valid email address. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach
  • Ensuring your account information remains current and accurate

2.3 Account Restrictions

Each account is personal to you and members of your household. You may not:

  • Transfer, sell, or share your account credentials with others outside your household
  • Create multiple accounts to circumvent usage limits or subscription tiers
  • Use another person's account without permission

2.4 Abuse Prevention

We reserve the right to suspend or terminate accounts, without refund, that demonstrate patterns of abuse, including but not limited to:

  • Repeatedly subscribing and cancelling in a manner designed to circumvent feature restrictions or abuse our service (subscription cycling)
  • Excessive automated, scripted, or bulk import requests that burden our infrastructure
  • Sharing account credentials beyond permitted household use
  • Using the Service in any manner that imposes an unreasonable or disproportionate load on our systems
  • Circumventing, disabling, or interfering with security features or usage limitations
  • Any coordinated behavior with other users to exploit the Service

We may, in our sole discretion, limit features, restrict access, or implement usage caps for accounts exhibiting suspicious or abusive patterns. Our determination of abuse is final and not subject to appeal.

3. Description of Service

JUSTCOOK is an AI-powered recipe management and meal planning application that enables you to:

  • Import recipes from various sources (web URLs, social media, photos, text, AI generation)
  • Organize recipes in custom cookbooks and collections
  • Plan meals using our intuitive meal planning interface
  • Generate and manage smart grocery lists with intelligent ingredient consolidation
  • Access nutritional information powered by USDA data
  • Sync your data across multiple devices
  • Access step-by-step cooking mode for hands-free recipe following

Our Service utilizes artificial intelligence and machine learning technologies, including OpenAI's language models (currently GPT-4o-mini or similar) and Google Cloud Vision API, to parse, normalize, and enhance recipe data.

4. Subscription Plans and Payment

4.1 Subscription Tiers

JUSTCOOK offers the following subscription tiers:

Free Trial (14 days):

  • Automatically activated for all new users upon account creation
  • No credit card or payment information required to start
  • No automatic charges at any time
  • Full access to all JUSTCOOK Pro features during the trial period
  • Recipe storage limit of 20 recipes during the trial period
  • Includes: unlimited web imports, OCR photo imports, social media imports, meal planning, grocery lists, cooking mode, and all advanced features

Basic Plan (Free, Post-Trial):

  • Automatically activated when your free trial expires (if you do not subscribe to JUSTCOOK Pro)
  • Also activated if your JUSTCOOK Pro subscription expires or is cancelled
  • Access to recipes saved during your original free trial period (up to 20 recipes)
  • Read-only access to view recipes saved during any prior JUSTCOOK Pro subscription period
  • Ability to use cooking mode and export your recipes
  • Cannot save, import, or create new recipes
  • Cannot access JUSTCOOK Pro features including: web/photo/social imports, meal planning, grocery list generation, or recipe editing

JUSTCOOK Pro Subscription (Monthly or Annual):

  • Unlimited recipe storage and organization
  • Unlimited web recipe imports
  • Unlimited OCR photo imports
  • Unlimited social media imports
  • Full access to meal planning and grocery lists
  • Full recipe editing and organization capabilities
  • Cooking mode with step-by-step guidance
  • Cloud sync across all your devices
  • Priority customer support
  • All current and future JUSTCOOK Pro features

4.2 Free Trial Policy

Trial Access: All new users receive a 14-day free trial with complete access to all JUSTCOOK Pro features. No credit card or payment method is required to start your trial, and you will never be automatically charged.

Trial Recipe Limit: During your free trial, you may save up to 20 recipes. This limit is designed to give you a full experience of JUSTCOOK's capabilities while encouraging subscription for unlimited storage.

Trial Expiration: At the end of your 14-day trial period, your account will automatically transition to the Basic Plan. You will retain access to recipes saved during your trial (your "Trial Recipes") but will not be able to save new recipes or access JUSTCOOK Pro features unless you subscribe.

No Automatic Charges: JUSTCOOK does not store payment information during your trial and will never automatically charge you. You maintain full control over whether and when to subscribe. Before your trial expires, you will receive notifications about your trial status.

4.3 Basic Plan and Post-Subscription Access

Transition to Basic Plan: Your account transitions to the Basic Plan when:

  • Your free trial expires without subscribing to JUSTCOOK Pro, OR
  • Your JUSTCOOK Pro subscription expires or is cancelled

Access to Your Content on Basic Plan:

  • Trial Recipes (recipes saved during your original 14-day trial): You retain full access to view, use in cooking mode, and export these recipes. These are permanently associated with your account.
  • JUSTCOOK Pro Recipes (recipes saved during any JUSTCOOK Pro subscription period): You retain read-only access to view these recipes and use them in cooking mode. You may also export these recipes. However, you cannot edit, organize, or add notes to JUSTCOOK Pro Recipes while on the Basic Plan.
  • Feature Access: JUSTCOOK Pro features including recipe importing (web, photo, social media), meal planning, and grocery list generation require an active JUSTCOOK Pro subscription. These features are not available on the Basic Plan.

Resubscription: If you resubscribe to JUSTCOOK Pro at any time, you immediately regain full access to all your recipes (both Trial and JUSTCOOK Pro Recipes) and all JUSTCOOK Pro features. Your content is preserved indefinitely while your account remains active.

Important Notice: The distinction between Trial Recipes and JUSTCOOK Pro Recipes is based on when the recipe was saved to your account, not the source or content of the recipe. JUSTCOOK Pro features and full editing capabilities are provided as part of the JUSTCOOK Pro subscription service, and access to these features requires an active subscription.

4.4 Payment and Billing

  • All subscription fees are charged in advance on a monthly or annual basis
  • Payments are processed through Apple App Store or Google Play Store in-app purchases, managed by RevenueCat
  • You authorize us to charge your chosen payment method at the beginning of each billing cycle
  • All fees are non-refundable except as required by law or as expressly stated in these Terms
  • We reserve the right to change subscription prices upon 30 days' notice, effective at the end of your current billing cycle

4.5 Subscription Management and Cancellation

Cancellation: You may cancel your JUSTCOOK Pro subscription at any time through your device's app store settings (Apple App Store or Google Play Store) or by contacting customer support. Cancellation will take effect at the end of your current billing period, and you will retain full JUSTCOOK Pro access until that time.

Effect of Cancellation: When your JUSTCOOK Pro subscription ends, your account transitions to the Basic Plan as described in Section 4.3. You do not lose your recipes. You retain read-only access to JUSTCOOK Pro Recipes and full access to Trial Recipes.

Refunds: All subscription fees are non-refundable except as required by applicable law. No refunds will be provided for partial subscription periods. Refund requests related to app store purchases must be directed to Apple or Google, as applicable.

5. License Grant and Restrictions

5.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the JUSTCOOK mobile application on devices you own or control for personal, non-commercial use only.

5.2 Restrictions

You agree not to:

  • Modify, reverse engineer, decompile, or disassemble the Service or any portion thereof
  • Remove, alter, or obscure any proprietary notices on the Service
  • Use the Service for any commercial purpose or on behalf of any third party
  • Use automated tools (bots, scrapers, crawlers) to access or collect data from the Service without our express written permission
  • Attempt to gain unauthorized access to any portion of the Service, other users' accounts, or our systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Upload or transmit viruses, malware, or other malicious code
  • Use the Service in any way that violates applicable laws or regulations

6. User Content and Data

6.1 Your Content Ownership

You retain all ownership rights to the recipes, meal plans, notes, images, and other content you create, upload, or import into the Service ("User Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, and process your User Content solely to:

  • Provide, maintain, and improve the Service
  • Display your User Content back to you across your synced devices
  • Process your User Content through AI/ML technologies to parse, normalize, and enhance recipe data
  • Generate nutritional information and meal planning suggestions

6.2 Data We Collect

When you use the Service, we collect and process:

  • Account Information: Email address, user ID, authentication credentials, subscription status
  • Recipe Data: Recipes you create or import, including titles, ingredients, instructions, images, sources, ratings, and notes
  • Usage Data: Features used, import counts, AI generation requests, meal plans, grocery lists
  • AI Learning Data: Raw text parsed by AI, AI model outputs, parsing confidence scores, user corrections to AI results, and feedback ratings
  • Analytical Data: Performance metrics, error logs, API costs, and feature engagement

6.3 Use of Your Data for AI Improvement

We may use user corrections and feedback on AI-parsed recipes to improve our AI models and service quality. This includes:

  • Storing user corrections to ingredient parsing, quantities, and units
  • Analyzing patterns in AI confidence scores and user satisfaction ratings
  • Training and refining our AI normalization algorithms

All AI learning data is anonymized and used only to improve service accuracy. We do not share your personal recipes or identifiable information with third parties for AI training purposes.

6.4 Prohibited Content

You agree not to upload, post, or transmit any User Content that:

  • Infringes on intellectual property rights of others
  • Contains personally identifiable information of others without consent
  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Contains viruses, malware, or other harmful code
  • Violates any applicable laws or regulations

We reserve the right to remove any User Content that violates these Terms, without notice.

6.5 Third-Party Recipe Sources and User Responsibility

Personal Use Only: JUSTCOOK provides recipe import tools solely to facilitate your personal, non-commercial recipe organization. The Service is intended for individual and household use, not for commercial food service, recipe redistribution, content aggregation, or any business purpose.

Your Responsibilities: When you import recipes from third-party sources (websites, social media platforms, photographs of cookbooks, or any other source), you represent and warrant that:

  • Your use of imported content complies with the source website's or content owner's terms of service, usage policies, and any applicable intellectual property rights
  • You are importing content solely for your own personal, non-commercial use within your household
  • You will not redistribute, republish, publicly share, or commercially exploit recipes imported through the Service
  • You have obtained any necessary permissions or licenses for content you import
  • You assume full responsibility for determining whether your importation and use of third-party content is lawful
  • You will respond to and comply with any valid takedown requests or legal claims regarding content you have imported

Our Limited Role: JUSTCOOK functions as a neutral tool that processes content at your direction. We do not:

  • Verify that you have rights to import specific content
  • Authorize or endorse the copying of any third-party content
  • Make any representations about the copyright status of recipes or content you import
  • Assume any liability for intellectual property disputes arising from your use of the Service

Recipe Attribution: When you import a recipe from a URL, we display a hyperlink to the original source. This attribution is provided as a convenience and does not constitute an endorsement, license, or authorization from the original content creator.

Indemnification for Imported Content: You agree to indemnify and hold harmless JUSTCOOK from any claims, damages, losses, or expenses (including attorneys' fees) arising from your importation of third-party content, including but not limited to claims of copyright infringement, trademark violation, or breach of third-party terms of service.

Content Removal: We reserve the right to remove any User Content, including imported recipes, that we believe in good faith may infringe third-party rights or violate these Terms, with or without notice to you.

7. AI and Third-Party Services

7.1 AI Processing

JUSTCOOK uses artificial intelligence services, including but not limited to:

  • OpenAI Language Models (currently GPT-4o-mini or similar): For recipe parsing and ingredient normalization
  • Google Cloud Vision API: For optical character recognition (OCR) of recipe photos

By using these features, you acknowledge that your recipe text and images may be processed by these third-party AI services. We take measures to protect your data, but we cannot guarantee the security or accuracy of third-party AI processing. AI-generated content may contain errors or inaccuracies.

7.2 USDA Nutritional Data

Nutritional information is derived from the USDA FoodData Central database and matched to recipe ingredients using AI algorithms. Nutritional data is provided for informational purposes only and should not be relied upon for medical, dietary, or health-related decisions. We do not guarantee the accuracy or completeness of nutritional information.

7.3 AI Parsing Accuracy and Limitations

No Guarantee of Accuracy: AI-powered features including recipe parsing, ingredient extraction, quantity detection, and recipe formatting are provided on a best-effort basis. You acknowledge that AI systems may:

  • Misinterpret, omit, or incorrectly parse ingredients, quantities, or measurements
  • Fail to detect all ingredients in a recipe
  • Make errors in unit conversions or serving size calculations
  • Produce inconsistent results for the same input
  • Contain errors that could affect recipe outcomes

Your Responsibility to Verify: YOU ARE SOLELY RESPONSIBLE FOR REVIEWING AND VERIFYING ALL AI-PARSED CONTENT BEFORE USE. We strongly recommend that you:

  • Compare AI-parsed recipes against the original source
  • Verify all ingredient quantities, especially for baking, canning, preserving, or any recipe where precision matters
  • Double-check critical ingredients and measurements before cooking
  • Never rely solely on AI-parsed content without verification

No Liability for AI Errors: JUSTCOOK SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY DAMAGES, INJURIES, ILLNESS, OR LOSSES ARISING FROM ERRORS IN AI-PARSED CONTENT, including but not limited to incorrect ingredient quantities, missing ingredients, improper cooking instructions, or any other parsing errors.

7.4 CRITICAL ALLERGEN AND DIETARY DISCLAIMER

⚠️ IMPORTANT HEALTH AND SAFETY WARNING ⚠️

JUSTCOOK MAY DISPLAY DIETARY LABELS AND CLASSIFICATIONS (SUCH AS "GLUTEN-FREE," "DAIRY-FREE," "VEGAN," "NUT-FREE," OR SIMILAR DESIGNATIONS) THAT ARE GENERATED BY ARTIFICIAL INTELLIGENCE. THESE LABELS ARE ALGORITHMIC ESTIMATES AND ARE NOT VERIFIED, CERTIFIED, OR GUARANTEED TO BE ACCURATE.

DO NOT RELY ON DIETARY LABELS FOR:

  • Managing food allergies or intolerances
  • Celiac disease or gluten sensitivity
  • Lactose intolerance or dairy allergies
  • Nut allergies or any life-threatening food allergies
  • Religious dietary requirements (kosher, halal, etc.)
  • Medical conditions requiring strict dietary control (diabetes, kidney disease, phenylketonuria, etc.)
  • Any health condition where consuming certain foods could cause illness, injury, or death

LIMITATIONS YOU MUST UNDERSTAND:

  • AI cannot detect cross-contamination risks
  • AI may not recognize all forms or derivatives of allergens (e.g., casein as a dairy derivative, or hidden gluten sources)
  • Ingredient lists from third-party sources may be incomplete or inaccurate
  • Brand-specific formulations may vary and contain unlisted allergens
  • "May contain" warnings and manufacturing facility information is not available through our Service

YOUR SOLE RESPONSIBILITY: If you have food allergies, dietary restrictions, or any medical condition affected by food consumption, you MUST:

  • Independently verify all ingredients with original recipe sources
  • Check all ingredient labels on actual products you purchase
  • Consult with your physician, allergist, or registered dietitian
  • NEVER rely on JUSTCOOK's dietary labels or nutritional information as your sole source of dietary guidance

COMPLETE RELEASE OF LIABILITY: BY USING THE SERVICE, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT JUSTCOOK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL HAVE ABSOLUTELY NO LIABILITY FOR ANY ALLERGIC REACTIONS, ADVERSE HEALTH EFFECTS, ILLNESS, INJURY, OR DEATH RESULTING FROM YOUR RELIANCE ON DIETARY LABELS, NUTRITIONAL INFORMATION, OR ANY OTHER CONTENT PROVIDED THROUGH THE SERVICE.

You use dietary labels and nutritional information entirely at your own risk. If accurate dietary information is critical to your health, do not use this feature.

7.5 Third-Party Integrations

The Service integrates with third-party services including:

  • Supabase: Database, authentication, and storage infrastructure
  • RevenueCat: Subscription and payment processing
  • Sentry: Error tracking and monitoring
  • Analytics Tools: We may use analytics services to understand how users interact with the Service

Your use of these services is subject to their respective terms of service and privacy policies.

7.6 Apple App Store and Google Play Store Terms

The JUSTCOOK mobile application is distributed through the Apple App Store and Google Play Store. Your use of the Service is also subject to the following:

For Apple App Store Users (iOS):

  • These Terms are between you and JUSTCOOK only, not Apple Inc. ("Apple"). Apple is not responsible for the Service or its content.
  • The license granted to you is limited to a non-transferable license to use the Service on Apple-branded products that you own or control, as permitted by the App Store Terms of Service.
  • Apple has no obligation to provide maintenance or support services for the Service.
  • Apple is not responsible for any claims relating to the Service, including product liability, regulatory compliance, or intellectual property infringement.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.
  • You represent that you are not located in a country subject to U.S. Government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. Government prohibited or restricted party list.

For Google Play Store Users (Android):

  • These Terms are between you and JUSTCOOK only, not Google LLC ("Google"). Google is not responsible for the Service or its content.
  • Google is not obligated to provide maintenance or support services for the Service.
  • Your use of the Service is also subject to the Google Play Terms of Service.

Subscription Payment Processing:

All subscription payments for JUSTCOOK Pro are processed through Apple App Store (for iOS) or Google Play Store (for Android), not directly by JUSTCOOK. By subscribing, you agree that:

  • Payment will be charged to your Apple ID or Google Play account at confirmation of purchase
  • Your subscription automatically renews unless cancelled at least 24 hours before the end of the current billing period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel subscriptions in your device's account settings (Apple: Settings > [Your Name] > Subscriptions; Android: Google Play Store > Subscriptions)
  • No refunds will be provided for unused portions of subscription periods; refund requests must be directed to Apple or Google as applicable

8. Intellectual Property

8.1 Our Intellectual Property

The Service, including its design, layout, text, graphics, logos, icons, images, software, and all other content (excluding User Content), is owned by JUSTCOOK and is protected by copyright, trademark, and other intellectual property laws.

The JUSTCOOK name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of JUSTCOOK. You may not use these marks without our prior written permission.

8.2 DMCA and Copyright Policy

We respect the intellectual property rights of others and comply with the Digital Millennium Copyright Act ("DMCA").

Filing a DMCA Notice: If you believe that content available through the Service infringes your copyright, please send a written notice to our DMCA Agent containing:

  • A physical or electronic signature of a person authorized to act on behalf of the copyright owner
  • Identification of the copyrighted work(s) claimed to have been infringed
  • Identification of the material that is claimed to be infringing and information reasonably sufficient to locate the material (e.g., user account, recipe title, or other identifying information)
  • Your contact information (address, telephone number, and email)
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

Counter-Notification: If you believe your content was removed by mistake or misidentification, you may submit a counter-notification to our DMCA Agent with the required information under 17 U.S.C. § 512(g)(3).

Repeat Infringers: We may terminate the accounts of users who are determined to be repeat infringers in appropriate circumstances.

We will respond to valid DMCA notices in accordance with applicable law, which may include removing or disabling access to the allegedly infringing material.

9. Privacy and Data Security

9.1 Privacy Policy

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of information as described in the Privacy Policy.

9.2 Data Security

We implement reasonable security measures to protect your data from unauthorized access, disclosure, alteration, or destruction. However, no system is completely secure, and we cannot guarantee the absolute security of your information. You use the Service at your own risk.

9.3 Data Retention

Active Accounts: We retain your User Content and account data for as long as your account is active. Your recipes and account data are preserved regardless of your subscription status (including on the Basic Plan), so long as your account remains active and you continue to use the Service.

Account Deletion: If you delete your account, we will delete your User Content immediately upon confirmation. Some backup data may be retained for up to 30 days before automatic purging. Certain data may be retained longer as required to comply with legal obligations or resolve disputes.

Account Inactivity: If your account remains completely inactive (no logins, no app usage) for twenty-four (24) consecutive months, we may:

  • Send a notice to your registered email address warning that your account and data may be deleted due to inactivity
  • If you do not log in within thirty (30) days of that notice, permanently delete your account and all associated data

We recommend logging into the Service periodically and ensuring your email address is current to avoid unintended data loss. You may also export your recipes at any time as a backup.

Survival of Content: For clarity, if you cancel your JUSTCOOK Pro subscription but continue to use the Service on the Basic Plan (even occasionally), your data will be preserved. The inactivity deletion policy applies only to accounts with no activity whatsoever for the specified period.

9.4 Data Portability and Export

Your Right to Export: You may export your recipes at any time, regardless of your subscription status. Basic Plan users retain the ability to export all recipes (both Trial Recipes and JUSTCOOK Pro Recipes) in standard formats. We believe your recipe data belongs to you, and we will not restrict your ability to take your data with you.

Export Methods: Recipe export functionality is available within the app. You may export individual recipes or your entire recipe collection. Exported data includes recipe titles, ingredients, instructions, notes, and associated metadata.

No Data Hostage: While JUSTCOOK Pro features require an active subscription, we do not hold your content hostage. You can always view and export your recipes, even on the Basic Plan.

9.5 Account Deletion

You may request deletion of your account at any time by contacting customer support or using the account deletion feature in the app settings. We recommend exporting your recipes before requesting account deletion. Upon account deletion:

  • All your recipes, meal plans, cookbooks, and grocery lists will be permanently deleted immediately upon confirmation
  • Some backup data may be retained for up to 30 days before automatic purging
  • Your subscription will be cancelled (no refunds for remaining subscription period)
  • Your personal information will be deleted in accordance with our Privacy Policy
  • Aggregate, anonymized usage data may be retained for analytics and service improvement

10. Disclaimers and Limitations of Liability

10.1 "As-Is" Disclaimer

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DATA.

WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted, secure, or error-free
  • The results obtained from the Service will be accurate or reliable
  • The quality of any products, services, information, or content obtained through the Service will meet your expectations
  • Any errors in the Service will be corrected
  • AI-generated or AI-parsed content will be accurate, complete, or suitable for any particular purpose

10.2 No Medical, Dietary, or Professional Advice

JUSTCOOK IS NOT A MEDICAL, DIETARY, OR NUTRITIONAL ADVICE SERVICE.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUSTCOOK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Service
  • Any conduct or content of any third party on the Service
  • Unauthorized access, use, or alteration of your User Content
  • Any errors, inaccuracies, or omissions in AI-generated or AI-parsed content, including recipe parsing errors, incorrect quantities, or missing ingredients
  • Any reliance on nutritional information, calorie counts, macro calculations, or dietary labels (including but not limited to "gluten-free," "dairy-free," "vegan," or similar classifications) provided through the Service
  • Any allergic reactions, adverse health effects, illness, injury, or death resulting from food prepared using recipes or information obtained through the Service
  • Any intellectual property claims, copyright disputes, or legal actions arising from content you import from third-party sources
  • Errors or omissions in recipes imported from third-party websites, social media, or other sources
  • Any interruption, suspension, or termination of the Service

SPECIFIC EXCLUSION FOR HEALTH-RELATED DAMAGES: WITHOUT LIMITING THE FOREGOING, WE EXPRESSLY DISCLAIM ALL LIABILITY FOR ANY HEALTH-RELATED DAMAGES, INCLUDING ALLERGIC REACTIONS, ANAPHYLAXIS, FOOD POISONING, ADVERSE DIETARY EFFECTS, OR ANY OTHER PHYSICAL HARM ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON ANY INFORMATION PROVIDED THROUGH THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10.4 Indemnification

You agree to indemnify, defend, and hold harmless JUSTCOOK and its officers, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your violation of these Terms
  • Your User Content or your use of the Service
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations

11. Future Features and Social Functionality

11.1 Future Features

We may introduce new features, functionality, or services to JUSTCOOK from time to time. Your use of any new features will be subject to these Terms as well as any additional terms we may provide at the time of release. We reserve the right to make new features available on a limited, beta, or JUSTCOOK Pro-only basis.

11.2 Social and Sharing Features (If Applicable)

JUSTCOOK may introduce features that allow users to share recipes, create public profiles, or interact with other users ("Social Features"). If and when Social Features become available:

  • You will be solely responsible for any content you choose to share publicly
  • Publicly shared content may be visible to other users and may be indexed by search engines
  • You grant JUSTCOOK and other users a license to view, use, and share publicly posted content as enabled by the Service
  • Additional copyright and intellectual property considerations will apply to shared content
  • You may not share content that infringes third-party intellectual property rights
  • We may require acceptance of supplemental terms before accessing Social Features

Until Social Features are officially launched and supplemental terms are provided, JUSTCOOK remains a personal, private recipe management tool and does not include any public sharing functionality.

12. Changes and Termination

12.1 Changes to the Service

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

12.2 Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by:

  • Posting the updated Terms with a new "Last Updated" date
  • Sending an email notification to the email address associated with your account
  • Displaying a prominent notice in the Service

Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and may cancel your subscription.

12.3 Termination by You

You may terminate your account at any time by:

  • Cancelling your subscription through your device's app store
  • Using the account deletion feature in the app settings
  • Contacting customer support

12.4 Termination by Us

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity (as described in Section 9.3)
  • Requests by law enforcement or government agencies

Upon termination, your right to use the Service will immediately cease, and we may delete your User Content.

12.5 Effect of Termination

Upon termination of your account:

  • Your subscription will be cancelled (no refunds will be provided)
  • You will lose access to the Service and all JUSTCOOK Pro features
  • Your User Content may be deleted in accordance with our data retention policies
  • Sections of these Terms that by their nature should survive termination will survive, including Sections 6, 8, 10, 13, and 14

13. Dispute Resolution and Governing Law

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law principles.

13.2 Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through the following process:

Informal Resolution: Before filing any formal claim, you agree to contact us at jack.jaxbit@gmail.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days.

Arbitration: If we cannot resolve the dispute informally, any remaining dispute shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association in Denver, Colorado. The arbitrator's decision will be final and binding, and judgment may be entered in any court of competent jurisdiction.

Class Action Waiver: You agree to resolve disputes with us on an individual basis and waive your right to participate in class actions, class arbitrations, or representative actions.

Exceptions: Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights.

13.3 Limitation on Time to File Claims

Any cause of action or claim you may have arising out of or relating to these Terms or the Service must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action or claim is permanently barred.

13.4 Consumer Rights in Certain Jurisdictions

Some countries, states, or jurisdictions do not allow mandatory arbitration, class action waivers, or certain limitations of liability. In those cases, the provisions of Sections 10 and 13 will apply to you only to the extent permitted by the laws of your place of residence, and your mandatory statutory consumer rights will prevail where they conflict with these Terms.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Service, constitute the entire agreement between you and JUSTCOOK regarding the Service and supersede all prior agreements and understandings.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by us.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms or our rights and obligations without restriction.

14.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, natural disasters, labor disputes, or internet service provider failures.

14.6 Export Compliance

You agree to comply with all applicable export and import laws and regulations. You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and you are not listed on any U.S. government list of prohibited or restricted parties.
